Heard learned counsel for the applicant and learned A.G.A. for the State and perused the FIR.
It is contended that about 6 kilograms of Ganja was allegedly recovered from the possession of the applicant. He was a poor man and was falsely implicated.
On the other hand, learned A.G.A. has submitted that the applicant failed to produce any licence.
Considering all facts and circumstances of the case as well as quantity of the Ganja, which was allegedly recovered, I find that it is a fit case for bail.
Let the applicant-Shyama be enlarged on bail on his executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Azamgarh in Case Crime No. 1170 of 2006, under Section 8/20 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station-Kotwali, District Azamgarh.
