Heard learned counsel for the applicant and learned A.G.A. for the State and perused the FIR and post-mortem report also.
It is contended that deceased (Smt. Kuldip Kaur) was physically disabled and was suffering from Polio. She was married with the applicant about 13 years ago and out of this wedlock, three children were born. Therefore, there is no question of torturing her and the husband loved very much.
On the other hand, learned A.G.A. has submitted that it is not clear as to when the lady had an attack of Polio.
Taking into consideration the arguments advanced on behalf of the parties and all facts and circumstances of the case, I find it appropriate to enlarge the applicant on bail.
Let the applicant-Swarn Singh be enlarged on bail on his executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of C.J.M., Rampur in Case Crime No. 1106 of 2006, under Section 306 I.P.C., Police Station-Bilaspur, District Rampur.
