Heard learned counsel for the applicant and the learned A.G.A.
It is contended by the learned counsel for the applicant Johar son of Mohd. Margoob was arrested and sent to district jail on 20.12.2005, the day of the alleged occurrence. He was arrested by the police of G.R.P. Railway on 13.12.2005. Thereafter, he was sent to the jail and he has been released from the district jail on 20.12.2005.
To ascertain the identification of the applicant, the learned C.J.M. Is directed to obtain the identification marks of the applicant Johar his thumb impression taken at the time of entry in the jail and he shall obtain the identification mark and thumb impression of the applicant from the district Jail Muzaffarnagar. The same shall be sent to this court before 16.10.2006. In the meantime, the learned A.G.A. shall file a counter affidavit and produce the case diary.
The office is directed to communicate a copy of this order to the learned C.J.M. Muzaffar Nagar for compliance.
