It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. His name came into light after 5 months of the alleged occurrence in the statement of the witnesses. According to their statement also the applicant was not seen at the time of committing the alleged offence. The naming of the applicant is after thought.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Narendrai involved in Case Crime No. 278 of 2006, under Sections 302 and 201 I.P.C., Police Station Nagina District Bijnor be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
