HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Janardan Sahai, J.

The petitioner was granted patta of fishery lease for a period of ten years, which is according to the petitioner is expiring on 18.9.1996. The prayer made in this writ petition is that the respondents be directed to decide the application of the petitioner for renewal of the lease. In Full Bench decision of this Court in 2006 (62) ALR 65 Ram Kumar and others Vs. State of U.P. and others it has been held that no renewal of fishery lease can be made because it creates a monopoly in favour of the lessee and deprives other persons who may be interested in taking the lease from being considered.

In view of the said decision the petitioner has no right to claim renewal. Dismissed.

14.9.2006.
