Heard learned Counsel for the applicant and learned A.G.A.

It is submitted by learned counsel for the applicant that the applicant is mother-in-law of the deceased. Co-accused Neelu the husband of the deceased gave the information to the police station concerned in respect of committing suicide by the deceased. On that information the inquest report was prepared on 21.7.206. At that time the first informant Rajpal Singh was present their and he is witness of the inquest report also, but the F.I.R. of this case has been lodged on 24.7.2006. The applicant is lady. General allegation are made against the applicant and other co-accused persons. The applicant was having no concerned with the family affairs of the deceased and her husband. The cause of death was hanging. The case of the applicant is distinguishable with the case of husband of the deceased.

After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without  expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.

Let the applicant  Smt Kasturi Devi involved in Case Crime No.  190  of 2006, under Sections  498-A, 304-B  I.P.C. and Sections ¾ dowry Prohibition Act, Police Station  Gulawati District  Bulandshahar be released on bail on her furnishing a personal bond and two  sureties each of the like amount to the satisfaction of the Court concerned.
