Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the information in respect of the recovery of the dead body was given at the police station and an F.I.R. has been lodged against the applicant and other co-accused persons. The applicant is the father in law of the deceased. He is having no concern with the family affairs of the deceased and her husband. During investigation the statement of Rubab Ali was recorded. According to his statement the applicant was catching hold the deceased and other co-accused strangulate the neck of the deceased.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Dilip Kumar involved in case crime no. 89 of 2006 under Sections 302,201 I.P.C., P.S. Sonha District Basti be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
