Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is named in the F.I.R. on the basis of the disclosure of his name by the witnesses and other co-accused. There is no eye witness account. Nothing incriminating has been recovered from the possession of the applicant. The case of the applicant is distinguishable with the case of the other co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Om Prakash involved in case crime no. 103 of 2006 under Sections 394,302,411 I.P.C., P.S. Nagina Dehat District Bijnor be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
