Civil Misc. Application No. 185011 of 2006 has been filed on behalf of the petitioner / applicant in the Contempt Petition, interalia, praying for being permitted to implead Deepak Kumar, presently posted as the Vice-Chairman, Kanpur Development Authority, Kanpur Nagar, as the opposite party no.2 in the Contempt Petition.
Having regard to the averments made in the aforesaid Application and its accompanying affidavit, the petitioner / applicant is permitted to implead the said Deepak Kumar, presently posted as the Vice-Chairman, Kanpur Development Authority, Kanpur Nagar, as the opposite party no.2 in the Contempt Petition.
Necessary amendments will be made within two weeks.
After the necessary amendments are made, as mentioned above, within the aforesaid period of two weeks, notice will be issued within another two weeks thereafter to the said Deepak Kumar (opposite party no.2) to show cause as to why he be not punished for having committed contempt of this Court by allegedly not complying with various orders mentioned in the order dated 29.11.2004 passed on the Contempt Petition.
Notice will be issued fixing 7.12.2006.
It is made clear that the said Deepak Kumar (opposite party no.2) is not required to appear in person before the Court at this stage.
Copies of the Contempt Petition as well as the aforementioned Application including Anenxures thereto as also copy of the order dated 29.11.2004 and copy of the present order will be sent alongwith the notice.
