Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is mother-in-law of the deceased and she was living separately. There is general allegation against the applicant and other co-accused persons. There is no specific allegation against the applicant. The marriage of the deceased was solemnized about 4 years prior to the alleged occurrence. The case of the applicant is distinguishable with the case of other co-accused persons.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Smt Bhoorii involved in Case Crime No. 230 of 2006, under Sections 498-A, 304-B and 201 I.P.C. and Sections ¾ dowry Prohibition Act, Police Station Zarif Nagar District Budaun be released on bail on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
