Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. but subsequently the waiter of the hotel disclosed the name of the applicant in the statement recorded under section 161 Cr.P.C. According to their statement the accused persons were calling to each other by name of the applicant. The applicant has not been put up for identification. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Virendra involved in case crime no. 1450 of 2005 under Sections 302/34 I.P.C., P.S. Kotwali District Moradabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
