This is an application for bail moved on behalf of the applicants Deshraj Kushwaha and Bal Chandra indicted in case crime Nos. 309 , 310 and 311 of 2006 under sections 307 I.P.C. section 2(B) 10/12 of Dacoity Affected Area Act and section 25 Arms Act P.S. Sri Nagar District Mahoba .
Heard Shri Suresh Chandra Mishra , learned counsel for the applicants, learned A.G.A. and have perused the record.
The learned counsel for the applicants submitted that it is a police encounter case in which none of the police personnel sustained injuries. According to the learned counsel the recovery of country made pistol of .315 bore is said to have been made from the possession of each of the applicants.
The learned A.G.A. argued that applicants were arrested on the spot and recovery of illicit weapons was made from their possession.
I have taken into consideration the submissions advanced on behalf of both the parties.
This being a case of no injury, I consider it to be a fit case for bail.
Let the applicants Deshraj Kushwaha and Bal Chandra indicted in case crime Nos. 309 , 310 and 311 of 2006 under sections 307 I.P.C. section 2(B) 10/12 of Dacoity Affected Area and section 25 Arms Act P.S. Sri Nagar District Mahoba , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
