Heard learned Counsel for the applicants and  learned A.G.A.

It is submitted by learned counsel for the applicants that the dead body of the deceased was found on a railway track. Its information was given by the Station Master to the police station concerned, thereafter, the F.I.R. was lodged by the brother of the deceased , in which nobody was named , but during investigation the names of the applicants have been disclosed by Mamta Singh Bhabhi of the deceased and Rajee Kumar Singh alias Guddu Singh in which it was alleged that the deceased was having illicit relations with the daughter of the applicants and the deceased was seen by the witnesses Rajeev Kumar Singh going towards the village of the applicants and there is no other evidence against the applicants.

After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without  expressing any opinion on the merits of the case, the applicants are entitled to be released on bail.

Let the applicants Jwala Prasad and Smt. Sita Devi  involved in Case Crime No. 522 of 2006, under Sections 302, 404, 120-B, 201 I.P.C., Police Station  Chunar District Mirzapur be released on bail on their furnishing a personal bond and two     sureties each of the like amount to the satisfaction of the Court concerned .
