This is an  application for bail moved on behalf of the applicant Vinay Kumar  indicted in case crime No. 208  of 2006  under sections 336, 420  I.P.C. P.S. Ekauna  District Deoria.

Heard Shri Dharmendra Singhal , learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that applicant is a employee of  proprietor  Paritosh Biswas who runs medical shop in the village Narayanpur. The learned counsel argued that applicant used to give  medicine for headache, vometting, fever to the customers on the instructions of  the proprietor of medical shop. The learned counsel argued that the husband of  Smt. Anari Devi  has filed affidavit stating that his wife never took treatment from the applicant

The learned A.G.A. argued that applicant was found doing medical practice without professional degree.

Having taken into consideration the submissions advanced on behalf of the both the parties and without expressing any opinion with regard to the merits of the case, I consider it to be a fit case for bail.        

Let the applicant Vinay Kumar  indicted in case crime No. 208  of 2006  under sections 336, 420  I.P.C. P.S. Ekauna  District Deoria , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
