This is an application for bail moved on behalf of the applicant Imran indicted in case crime No. 22 of 2006 under sections 379, 411 I.P.C. P.S. Kutubsher District Saharanpur .
Heard Shri Manoj Vashisth , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the recovery of stolen motorcycle is said to have been made from the possession of the applicant. The learned counsel urged that applicant is in jail for the last about four months and the offences are triable by the Magistrate Ist class. The learned counsel submitted that there is no criminal history of the applicant prior to the present case.
The learned A.G.A. argued that the recovery of stolen motorcycle was made from the possession of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist class. The applicant is in jail for the last about four months. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Imran indicted in case crime No. 22 of 2006 under sections 379, 411 I.P.C. P.S. Kutubsher District Saharanpur , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
