The petitioner, aggrieved by inaction on the part of the respondents regarding his fishing rights in the pond in question, has approached this Court by means of this writ petition under Article 226 of the Constitution of India that since the petitioner has started fishing in the year 2002 because of the previous litigation he should be allowed to complete ten years' term from 2002.

Be it as it may be. In case the petitioner feels aggrieved by the inaction of the respondents in not extending the period of fishing rights for ten years from the date of fishing operation, the petitioner has a right to file a suit for damages. This writ petition is, therefore, dismissed on the ground of alternative remedy of filing suit for damages.
