This is an application for bail moved on behalf of the applicant Mahesh indicted in case crime No. 103 of 2006 under sections 307, 504 I.P.C. P.S. Gangiri District Aligarh .
Heard Shri Akhilesh Srivastava , learned counsel for the applicant, Shri V.S. Rajpoot, learned counsel for the complainant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that it is a case of no injury. According to the learned counsel the applicant has been falsely implicated due to party faction.
The learned A.G.A. and learned counsel for the complainant submitted that applicant fired two shots from his riffle but complainant and his brother had a narrow escape.
I have taken into consideration the submissions made on behalf of both the parties.
This being a case of no injury, I consider it to be a fit case for bail.
Let the applicant Mahesh indicted in case crime No. 103 of 2006 under sections 307, 504 I.P.C. P.S. Gangiri District Aligarh , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
