This is an application for bail moved on behalf of the applicant Pawan Kumar indicted in case crime No. 377 of 2006 under sections 379,411 I.P.C. P.S. Baraut District Baghpat .
Heard Shri Ajay Kumar Singh , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that recovery of about 17 meters telephone cable is said to have been made from the possession of the applicant. The learned counsel urged that there is no criminal history of the applicant.
The learned A.G.A. argued that applicant was arrested at the spot and recovery of telephone cable was made from his possession.
I have taken into consideration the submissions behalf on behalf of both the parties.
The offences are triable by the Magistrate Ist class. The applicant is in jail for the last about two months. There is no criminal history of the applicant.In view of these facts, I consider it to be a fit case for bail.
Let the applicant Pawan Kumar indicted in case crime No. 377 of 2006 under sections 379,411 I.P.C. P.S. Baraut District Baghpat , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
