Heard counsel for the petitioner.
The petitioner purchased the disputed shop by registered sale deed from the erstwhile Shri Gauri Shankar son of Sri Ganga Saran, resident of Maheshwari Colony, Pilukhwa, Hapur, district Ghaziabad. The petitioner has come up in this writ petition against the impugned order dated 18.8.2006 passed by Additional District Judge, Ghaziabad in Rent Control Revision No. 63 of 2006-Anwar Ahmad V. Rahisuddin appended as Annexure 10 to the writ petition.
By the aforesaid order, the revisional Court has remanded the matter to the Prescribed Authority to pass a fresh order in the light of the observations made in the revisional order.
The matter has only been remanded back to the Prescribed Authority. It is not final determination of the case.
In the facts and circumstances of the case, this Court is not inclined to interfere in the writ jurisdiction under Article 226 of the Constitution.
The writ petition is dismissed. No order as to costs.
