Heard Sri Dharmendra Singhal, learned counsel for the applicants, learned A.G.A. and perused the record.

Accused applicants are alleged to have attacked Nasir Ahmad and Musheer Ahmad on 10.12.2005 in the day time causing them injuries. Nasir Ahmad received fracture of his nasal bone. Learned counsel for the applicants has contended that injuries were also received by the applicants and Rizwan had fracture in his skull bone as per the

x-ray report paper no. 20. He has also filed the copies of the injury report of the accused  applicant Farhan paper no 20 and Rizwan paper no. 22. It appears that there is cross version also.

In the facts and circumstances of the case, accused are entitled to bail.

Let the applicants Bachchan @ Farhan and Shanu @ Rizwan involved in case Crime No. 386 of 2005 under Sections 323, 504, 506, 308, 325 IPC  P.S. Kotwali Fatehpur, District Fatehpur be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. They shall also give an undertaking that they will not indulge in any such activity and will not cause any threat to the complainant/witnesses. If any adverse report is made against them, it shall be open for the Court below to report to this Court so that their bail may be cancelled.
