Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the alleged incident had taken place in the dark hours of night at about 9.30 p.m. It is stated that the applicant discharged shots by his country made pistol consequently, the deceased received injuries. In the injured condition the deceased was taken to the District Hospital where he was medically examined. According to the medical examination report he was received injuries on both side upon the abdomen. The same position was in the medical examination report of J.N. Medical College Hospital.
According to the post mortem examination report the deceased has received 6 injuries. Injury nos. 1 and 2 wee on the left forearm and right forearm. The dimension of the injury were 32 cm x 10 cm and 24 cm x 7 cm. These injuries have not been explained.
It is contended that the presence of the first informant and other witnesses are highly doubtful.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Anshul Sharma alias Chintoo involved in case crime no. 85 of 2006 under Sections 302 I.P.C.,P.S. Delhi Gate District Aligarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
