Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the only evidence of last seen and recovery of Gamcha, Kurta and Paijama has been shown at the pointing out of the applicant. It is stated that the recovered cloths were belonging to he deceased. There is no direct eye witness account and the applicant is not having criminal antecedent.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Onkar Singh
involved in case crime no. 50 of 2006 under Sections364,302,201,34 I.P.C. P.S. Pisawa District Aligarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
