Heard Sri R.S.Rai, learned counsel for the applicant, learned A.G.A. and perused the record.
Accused is alleged to have been found in possession of seven grams of smack on 1.12.2005. Learned counsel for the accused applicant has contended that applicant has been falsely implicated in this case and there is no criminal history against the accused and that the alleged recovered quantity is much less than commercial quantity. He also contended that accused shall not commit such crime in future.
In the facts and circumstances of the case, accused is entitled to bail.
Let the applicant Chhail Behari Kurmi involved in case Crime No. 99 of 2005 under Section 8/21 of N.D.P.S. Act, P.S. Rajapur, District Chitrakoot be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. He shall also give an undertaking that he will not indulge in any such activity in future. If any adverse report is made against him, it shall be open for the Court below to report to this Court so that his bail may be cancelled.
