Heard counsel for the Parties.

This is tenant's petition.  Respondent no. 2 is the landlord of the disputed premises, who filed release application dated 23.4.97 under Section 21(1)(a) of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972 (hereinafter referred to as ''the Act') for eviction of the tenant on the ground of running business of book binding and printing.

Petitioner-tenant contested the release application by filing written statement denying the claim of the landlord on the ground that the need set up by this landlord was sham and fictitious.

Both the Courts below have recorded a concurrent finding of fact that the need of the landlord is genuine and bona fide. While Prescribed Authority has recorded that :-

The revisional Court while affirming the finding of fact recorded by the Trial Court has held that :-

eSaus Ik=koyh ij miyC/k I{kksa dh lk{; dk foLrkj ls fo'ys"k.k Hkh fd;k gS fd mDr fu.kZ; esa fdlh izdkj dh rF;kRed ,oa fof/kd =qfV ugha gS A fu;r vf/kdkjh Ojnkjk izkFkZuki= Lohdkj djusa dks dksbZ =qfV ugha dh x;h gS A ,slh n'kk esa vihy Lohdkj gksus ;ksX; ugha ik;h tkrh gS vkSj fujLr gksus ;ksX; ik;h tkrh gS A"

Thus, it has been found by both the Courts below that the petitioner-tenant has got her own shop and she has engaged her son in business whereas the landlord has no other alternate accommodation to earn his livelihood.

No illegality or perversity in the orders impugned could be pointed out by the counsel for the petitioner and no case has been made out for interference in the writ jurisdiction under Article 226 of the Constitution of India.

For the reasons stated above, the writ petition is dismissed. The tenant-petitioner is directed to vacate the disputed accommodation within two months from today and pay the arrears of rent, if any, to the landlord within the same period.  If the accommodation in dispute is not vacated or the arrears of rent are not paid within the stipulated period, she will be evicted with the assistance of local Police and the arrears of rent, if any, will be recoverable as arrears of land revenue.  No order as to costs.
