Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to the F.I.R. the applicant and 3 other co-accused persons caused the injuries by using lathi and danda and handle of the hand pump, but during investigation it has been specifically alleged that the applicant was having handle of the hand pump and co-accused Atar Singh was armed with lathi and they caused injuries on the person of the deceased. Co-accused Atar Singh has been released on bail by this court on 2.7.2006. The applicant is also entitled to get the benefit of parity.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Subhash involved in Case Crime No. 84 of 2006, under Sections 304 I.P.C. Police Station Khurja District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
