Ajay Singh v. State Of U.P - CRIMINAL MISC. BAIL APPLICATION No. 19888 of 2006 RD-AH 16547 (21 September 2006)
Hon'ble V.D. Chaturvedi J.
It is alleged that on 16.6.2006 at about 11 p.m. the applicant and three others looted Rs.8000/- from the conductor of Roadways Bus. Next day the applicant was arrested in police encounter and Rs.1000/- were also recovered from him. The cases whereupon the Gangsters Act was slapped includes only three cases, one of looting the bus, the another of police encounter and third one of the recovery of country made pistol made on 17.6.2006. Considering that there was no criminal history before 16.6.2006 and the applicant is in jail for more than three months, I deem it proper to enlarge the applicant on bail.
Let the applicant Ajay Singh be released on bail in case Crime No.88 of 2006 u/ss 394, 411 IPC and 2/3 U.P. Gangsters and Anti Social Activities(Prevention) Act, P.S.Jethwara, district Pratapgarh on his executing a personal bond of Rs.40000/-(Forty thousand) and furnishing two sureties each in the like amount to the satisfaction of court concerned.
