This is an application for bail moved on behalf of the applicant Asha indicted in case crime No. 2766 of 2006 under sections 5/6 of Immoral Traffic Prevention Act P.S. Kotwali District Bareilly .
Heard Shri Awadhesh Kumar Srivastava, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant is a married woman with children and has been falsely implicated in the present case. The learned counsel argued that the applicant is active leader of Bahujan Samaj Party and agitates the cause of people of weaker section by organising Dharna etc. The learned counsel submitted that on the date of occurrence the friends and family members of applicant had assembled at her residence in the birthday party of her child.
The learned A.G.A. argued that applicant was found carrying flesh trade at her residence and recovery of women and customers was made from her place.
Having taken into consideration the submissions advanced on behalf of the both the parties and without expressing any opinion with regard to the merits of the case, I consider it to be a fit case for bail.
Let the applicant Asha indicted in case crime No. 2766 of 2006 under sections 5/6 of Immoral Traffic Prevention Act P.S. Kotwali District Bareilly , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
