Gajraj v. State Of U.P. & Others - WRIT - C No. 52445 of 2006 RD-AH 16570 (21 September 2006)
Hon'ble Anjani Kumar, J.
Heard learned counsel appearing on behalf of the parties.
The petitioner aggrieved by the order passed by the Additional Commissioner (Administration), Meerut Division, Meerut dated 14th August, 2006 who while admitting the revision filed by the petitioner against the order of the appellate authority has passed an order directing the parties to maintain the status-quo till the next date of listing i.e. 4th September, 2006, approached this Court by means of present writ petition under Article 226 of the Constitution of India. On 4th September, 2006 the appeal was admitted and the notices were issued. It is stated at Bar that thereafter dates have been fixed but the interim order is always extended. It has not been stated by learned counsel for the petitioner that he has filed any application for vacation of the interim order and the same has not been heard.
In this view of the matter, this is not a fit case for interference by this Court in exercise of jurisdiction under Article 226 of the Constitution of India. This writ petition is accordingly dismissed. However, there will be no order as to costs.
