The grievance of the petitioner is that the land question was reserved for the purposes of construction of Primary Health Centre in his village but now it is intended to be established in some other village. Learned counsel for the petitioner further submits that for the said grievance, the petitioner has submitted an application before the District Magistrate, Firozabad, the copy of which is annexed as Annexure 2 to the writ petition which is still pending.
We have heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.
The learned Standing Counsel appearing for the respondents has submitted that instead of deciding the matter by this Court, the District Magistrate may be requested to consider and decide the claim of the petitioner in accordance with law.
In view of the above, we dispose of this writ petition with a direction to the District Magistrate, Firozabad, the respondent no.2 to consider the claim of the petitioner and pass appropriate order expeditiously preferably within a period of three weeks from the date of filing a certified copy of this order before him.
