This is an application for bail moved on behalf of the applicant Jitendra alias Jitu indicted in case crime No. 257 of 2006 under section 394 I.P.C. P.S. Tundla District Firozabad .
Heard Shri Anil Dhaka , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that mobile phone and motorcycle of the complainant's brother was looted by co-accused Sonu son of late Vinay Singh and co-accused Sonu had opened fire at complainant's brother. The learned counsel urged that no recovery of looted property was made from the possession of the applicant.
The learned A.G.A. argued that the applicant is involved in a case of highway robbery and looted motorcycle and mobile phone from the complainant's brother. The learned counsel submitted that co-accused Sonu son of late Vinay Singh is still at large.
I have taken into consideration the submissions advanced on behalf of both the parties.
The recovery of looted motorcycle and mobile phone having not been made from the possession of the applicant , I consider it to be a fit case for bail.
Let the applicant Jitendra alias Jitu indicted in case crime No. 257 of 2006 under section 394 I.P.C. P.S. Tundla District Firozabad , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
