This is an application for bail moved on behalf of the applicant Niranjan Singh indicted in case crime No. 187 of 2006 under sections 380, 411, 457 I.P.C. P.S. Raya District Mathura .
Heard Shri Ajay Dubey , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the recovery of mustered was made from Tata truck no. U.P. 85-C- 9372 in which the applicant was not on board. The learned counsel submitted that applicant was travelling in vehicle no. U.P. 94-B-8897 in which the gas cylinders were loaded. The learned counsel argued that joint recovery of stolen mustered is said to have been made from the possession of accused persons
The learned A.G.A. argued that both the vehicles were used by the applicant and co-accused persons for transportation of stolen goods.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the magistrate Ist class. The recovery of stolen mustered was not made from the Tata truck in which the applicant was aboard. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Niranjan Singh indicted in case crime No. 187 of 2006 under sections 380, 411, 457 I.P.C. P.S. Raya District Mathura , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
