The applicant is involved in case crime No. 76of 2006 under section 2/3 Gangster Act, P.S. Aliganj, district Etah
on the basis of three cases (i) (Crime No. 150/06), under Section 307 IPC, P.S. Aliganj, district Etah, (ii) Crime No. 191/06 under Section 25 Arms Act, P.S. Aliganj, district Etah and (iii) crime No. 155 of 2006, under Section 379/411 IPC, P.S. Aliganj, district-Etah. The applicant's counsel pleaded that the applicant has been admitted to bail in all of the three cases. The learned A.G.A. opposed on the ground that the bail of the co-accused has been refused.
Considering that all the three cases whereupon Gangster Act was slapped were registered consecutively as crime No. 150, 151 and 155 of 2006 at P.S. Aliganj, district Etah and that before the registration of these crimes there was no criminal history against him and that he has been admitted to bail, as submitted by him, in these three offences, I deem it proper to enlarge the applicant on bail.
Let the applicant Anar Singh involved in case crime No. 76 of 2006 under Sections 2/3 Gangster Act, P.S. Aliganj, district Etah be released on bail on his executing a personal bond for Rs. 50,000/- (Fifty thousand) and furnishing two sureties each in the like amount to the satisfaction of the Magistrate concerned.
