This is an application for bail moved on behalf of the applicant Shashi Kapoor Singh alias Guddu Singh indicted in case crime No. 221 of 2006 under sections 3/25 Arms Act P.S. Bakhira District Sant Kabir Nagar.
Heard Shri Snehil Srivastava, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant was arrested in police encounter case in which none of the police personnel sustained injuries. The learned counsel argued that recovery of country made pistol of .12 bore and two live cartridges was made from the possession of the applicant. The learned counsel submitted that there are no public witnesses to the recovery.
The learned A.G.A. argued that recovery of country made pistol and looted cash of Rs. 4100/- was made from the possession of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant has been enlarged on bail by an order of this court dated 6.9.2006 in case crime no. 211 of 2006 under sections 392 and 411 I.P.C. passed in Criminal Misc. Bail Application No. 13380 of 2006. There are no public witnesses to the recovery of illicit weapons and none of the police personnel sustained injuries. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Shashi Kapoor Singh alias Guddu Singh indicted in case crime No. 221 of 2006 under sections 3/25 Arms Act P.S. Bakhira District Sant Kabir Nagar , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
