HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon. Sunil Ambwani, J.

Heard Sri S.P. Sharma, learned counsel for the petitioner and Sri B.K.Singh counsel for respondents.

The petitioner served as Telecom Assistant in Bharat Sanchar Nigam Ltd. By order dated 28.3.2003, on her request, she was transferred to Agra temporarily for a fixed period of one year.  The transfer order was extended twice and that the period of extension in terms of the last extension expired  on 12.7.2006. By the impugned order dated dated 7.9. 2006, the petitioner has been relieved to attend at her parent department SSA.

Learned counsel for the petitioner states that she is serving in the same telecom circle and that  some disputes are  pending between her and her husband.  She has filed a FIR under Section 498A, I.P.C.   She  has prayed for quashing the order dated 7.9.2006 and to direct the respondents not to interfere with her peaceful functioning as TTA in the office of BSA Agra.

The period of temporary transfer was extended twice. Her husband against whom allegation has been made for influencing her transfer has not been impleaded as a party.  Even otherwise, it does not appear that her husband is in such a position to influence the transferring authority.  In the facts and circumstances it would be in petitioner's interest to accept the transfer.  I do not find that the petitioner has any legal rights or equity in her favour to consider the reliefs prayed for in the writ petition.

The writ petition is dismissed.

Dt. 21.9.2006.
