Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. His name has not been disclosed by any witness. The only allegation against the applicant is that his name has been disclosed by the co-accused Saleem. Some of the looted cycle parts was recovered from the possession of the applicant of which the applicant was not having any knowledge that the recovered article was looted property. The co-accused Shamshad alias Shammi whose case is on the same footing has been released on bail by this court on 8.9.2006 in case criminal misc. bail application no. 18519 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Dilshad alias Munshi involved in case crime no. 190 of 2006 under Sections 396,412,210 I.P.C. P.S. Kharkhauda District Meerut be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
