Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that co-accused Hori Lal and and Kallu have been released on bail by this court on 31.8.2006 and 24.8.2006 in Criminal Misc Bail Applications No.18258 of 2006 and 15479 of 2006 respectively. The case of the applicant is on the same footing with the case of above mentioned co-accuse. The applicant is also entitled to get the benefit of the parity.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Kariya involved in Case Crime No. 170of 2006, under Section 302 I.P.C. and Crime No. 242 of 2006, Sections 25/27 Arms Act, Police Station Maudaha District Hamirpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
