It is submitted by learned counsel for the applicant that according to the prosecution version the alleged occurrence had taken place in the dark hours of night at 1.00 a.m. Its F.I.R. was lodged 27.5.2006 at 4.10 a.m. The applicant is not named in the F.I.R. It is alleged that 4 or 5 unknown miscreants have committed the alleged offence, but on 22.7.2006 the name of the applicant has been disclosed by witness Ramraj, who was the witness of the inquest report. The naming of the applicant is after thought.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Ram Prawesh involved in Case Crime No. 206 of 2006, under Sections 302 I.P.C., Police Station Gahmar District Ghazipur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
