This is an application for bail moved on behalf of the applicant Shamshul Khan indicted in case crime No. 330 of 2006 under sections 489-A, 489-B, 489-C I.P.C. P.S. Kotwali District Farrukhabad.
Heard Shri A.P. Tewari, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that recovery of 70 fake currency notes of Rs. 100 denomination is said to have been made from the possession of the applicant. The learned counsel argued that applicant having been found in possession of counterfeit currency notes the offence under section 489 ( C) I.P.C. is made out which is bailable. According to the learned counsel there is no criminal history of the applicant.
The learned A.G.A. argued that fake currency notes worth Rs. 7000/- and 1.600 gm. opium was recovered from the possession of the applicant
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant is said to have been found in possession of 70 fake currency notes of Rs. 100 denomination. Looking to the allegations, I consider it to be a fit case for bail.
Let the applicant Shamshul Khan indicted in case crime No. 330 of 2006 under sections 489-A, 489-B, 489-C I.P.C. P.S. Kotwali District Farrukhabad , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
