This writ petition has been filed raising a grievance for not granting affiliation to the petitioners' College for B.Ed. course for the academic session 2005-06 inspite of the fact that the petitioners fulfill all the eligibility as required under the law. Learned counsel for the respondents has raised a preliminary objection that the petitioners do not fulfill the requisite eligibility. However, a supplementary affidavit has been filed today by Sri Pankaj Mishra, learned counsel for the petitioners who submitted that all the objections raised by the respondents have been removed and the petitioners fulfill all the requisite eligibility.
In view of above, instead of entering into the controversy, as it involves the fate of the students, it is desirable that the respondents no. 2 and 3 would sent the inspection team as early as possible preferably within three weeks from today and the inspection team is requested to submit report within a period of one week thereafter. The said report shall be forwarded forthwith to the learned Chancellor of the M.J.P. Rohilkhand University, Bareilly. We request the learned Chancellor to consider the report and pass appropriate orders in accordance with law.
With these observations the writ petition is disposed of.
