Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the applicant and co-accused Aqbal had caused the injuries on the person. Co-accused Aqbal has been released on bail by this court on 17.8.2006 in Criminal Misc Bail Application No. 16715 of 2006. The case of the applicant is on the same footing with the above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Banney involved in Case Crime No.101 of 2005, under Sections302, 307 and 506 I.P.C. and Section 7 of the Criminal Law Amendment Act, Police Station Bardah District Azamgarh be released on bail his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
