Civil Misc. (Substitution) Application No. 5183 of 1991 (Dated 7-10-1991).

Perused the Office Report dated 22nd September, 2006 (Item No. I) in regard to service of notice issued to the proposed heir and legal representative of the defendant-respondent No. 4, pursuant to the order dated 7-10-1991 passed by the Joint Registrar, on the aforementioned Substitution Application.

In view of the said Office Report, service of notice on the proposed heir and legal representative of the defendant-respondent No. 4 is held to be sufficient.

The aforementioned Substitution Application will be listed for consideration on the next date of listing.

Civil Misc. (Substitution) Application No. 5096 of 1991 (Dated 3-10-1991).

Perused the Office Report dated 22nd September, 2006 (Item No. II) in regard to service of notice issued to the proposed heir and legal representative of the plaintiff-respondent No. 1, pursuant to the order dated 3-10-1991 passed by the Joint Registrar on the aforementioned Substitution Application.

In view of the said Office Report, service of notice on the proposed heir and legal representative of the plaintiff-respondent No. 1 is held to be not sufficient.

Let fresh notice be issued to the proposed heirs and legal representatives of the plaintiff-respondent No. 1 on the aforementioned Substitution Application by Registered Post A.D., fixing 5th March, 2007.

Steps will be taken by the learned counsel for the defendants-appellants within eight weeks, failing which, the case will be listed before the Court under Chapter XII, Rule 4 of the Rules of the Court immediately on the expiry of the said period.

List on 5th March, 2007.
