Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is mother-in-law of the deceased. There are general allegation in respect of the demand of dowry and committing the cruelty with the deceased against the applicant and other co-accused persons. The father-in-law of the deceased Ramji Lal has bee released on bail on 18.8.2006 by the learned Sessions Judge. The cause of death is hanging. The case of the applicant is distinguishable with the case of the husband of the deceased.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Smt Vimla Devi involved in Case Crime No. 170 of 2006, under Sections 498-A, and 304-B I.P.C. and Section ¾ Dowry Prohibition Act, Police Station Gandhi Park District Aligarh be released on bail on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
