Heard Sri U. C. Mishra, learned counsel for the applicant, learned A.G.A. and perused the record.
According to prosecution case, accused applicant is alleged to have committed rape on Smt. Rita Devi, deorani of the complainant on 26.10.2005. It appears that the application was given to S.S.P., in this connection, who directed for investigation and registration of the case on 17.11.2005 and thereafter report was lodged on 18.11.2005.
Learned counsel for the accused applicant has contended that applicant has been falsely implicated and that no reasonable explanation of delay has been given by the prosecution.
In the facts and circumstances of the case, accused is entitled to bail.
Let the applicant Karu Rajpoot involved in case Crime No. 98 of 2005 under Sections 376 IPC and Section 3(1)(XII) SC/ST Act, P.S. Basrehar, District Etawah be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. He shall also give an undertaking that he will not indulge in any such activity and will not cause any threat to the complainant/witnesses. If any adverse report is made against him, it shall be open for the Court below to report to this Court so that his bail may be cancelled.
