Heard learned counsel for the petitioner and also Sri Akhilesh Chandra Srivastava, appearing for Opp. Party no.3 i.e. the principal of the Bamnai Janta Inter College Bamnai Hathras. A detailed counter affidavit has also been filed by Sri Ram Autar Dixit, Principal arrayed as Opp. Party no.3 in which he has denied the allegations made in the writ petition.
It would appear from a perusal of the counter affidavit that the Opp. party has denied the allegations of demand of bribery from the petitioner.
The learned Standing counsel appearing for the State authorities has stated across the bar that the petitioner has been awarded average mark in the paper in which answer-sheet was reportedly mislaid. He further informed the Court that mark-sheet as well as certificate are ready and both these documents would be transmitted/handed over to the petitioner forthwith.
In so far as allegations of mislaying of answer-sheet of the petitioner are concerned the learned standing counsel has intimated the Court that some enquiry ordered by the Secretary, Board of High School and Intermediate is under-way.
In the above perspective, the writ petition is disposed of accordingly.
