It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. The name of the applicant has been disclosed by co-accused during investigation. There is no direct eye witness account. Co-accuse Brijesh Gautam has been, whose case is on the same footing with the case of the applicant, has been released on bail on 23.5.2006 in Criminal Misc. Bail Application No. 9989 of 2006.
After considering the facts and circumstances of the case the applicant is not entitled for bail on merits, but for the purpose of doing the parivi of the case, the applicant is lady and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rahul Yadubanshi involved in Case Crime No. 48 of 2006, under Sections 302, 201, 394, 411 and 506 I.P.C., Police Station Kashganj District Etah be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
