Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. His name has been disclosed by the co-accused Chhatwa alias Chhotey during trial. Nothing incriminating has been recovered from the possession of the applicant or at his pointing out.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Abrar involved in case crime no. 198 of 2005 under Sections 302 I.P.C., P.S. Masoori District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
