This is an  application for bail moved on behalf of the applicant Akram alias Bholu   indicted in case crime No. 64  of  2006 under sections 380 448, 454,  I.P.C. P.S. Kotwali  District Agra .

Heard Shri Rahul Jain , learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that the applicant is not named in the First Information Report and no recovery was made from his possession or at the pointing out of the applicant. The learned counsel argued that co-accused Tahir and Bantoo alias Javed have been granted bail by an order of this court dated 26.7.2006 passed in Criminal Misc. Bail Application no. 15100 of 2006.

The learned A.G.A. argued that the complainant is an advocate and his office was ransacked by the named accused and their associates and law books and other goods valuing Rs. ten lacs were stolen.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant is not named in the First Information Report .His name came to light during the investigation. No recovery of stolen properties was made from the possession of the applicant. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Akram alias Bholu   indicted in case crime No. 64  of  2006 under sections 380, 448, 454,  I.P.C. P.S. Kotwali  District Agra , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
