It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification and no looted property has been recovered from the possession of the applicant. His name has been disclosed by co-accused Dharmendra Gupta alias Dharam, who has been released on bail by this court on 2.8.2006 in Criminal Misc Bail Application No. 15683 of 2006. The case of the applicant is on the same footing with the case of the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Dharma alias Dharma Singh involved in Case Crime No. 429 of 2006, under Sections 396 and 120-B I.P.C. , Police Station Chhibramau District Kannauj be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
