Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that in the present case the F.I.R. has been lodged after recovery of the dead body. The applicants are named in the F.I.R, but there is no direct eye witness account. Nothing incriminating has been recovered from the possession of the applicants are their pointing out. They have been named in the F.I.R. on the basis of the doubt and suspicion.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Gajendra and Kaushal alias Gatta involved in Case Crime No. 177 of 2006, under Sections 364, 302 and 201 I.P.C. and Sections 3(2)(5) of the S.C./S.T.(P.A.) Act, Police Station Sikandra Rau District Hathras (Mahamaya Nagar) be released on bail on their furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
