This is an application for bail moved on behalf of the applicant Lalji Maurya indicted in case crime No. 371 of 2000 under sections 8/23 of N.D.P.S. Act P.S. D.R.I District Varanasi.
Heard Shri Rajendra Singh, learned counsel for the applicant, Shri Ravi Prakash Tripathi holding brief of Shri Sanjay Singh, learned counsel for the opposite party, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the recovery of about 5.4 Kg. Nepali Ganja is said to have been made from the possession of the applicant. The learned counsel submitted that there is no criminal history of the applicant.
The learned counsel for the opposite party contended that recovery of Nepali Ganja more than small quantity was made from the possession of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The quantity of recovered Nepali Ganja being below commercial quantity, I consider it to be a fit case for bail.
Let the applicant Lalji Maurya indicted in case crime No. 371 of 2000 under sections 8/23 of N.D.P.S. Act P.S. D.R.I District Varanasi, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
